These terms explain how Hostcari services work and how accounts, payments, renewals, hosting, content, and ownership are handled.
1. Agreement and scope
These Terms of Service govern access to Hostcari websites, checkout flows, client portal, hosting, website management, email-related tools, support, and any related services provided by Hostcari. A written order, invoice, proposal, plan description, or service agreement may add service-specific terms. If there is a conflict, the more specific written agreement controls for that service.
2. Eligibility and account information
Clients must provide accurate account, business, billing, and contact information and keep it current. The client is responsible for activity under its account, authorized users, portal access, uploaded materials, and any instructions submitted through the portal or approved communication channels.
3. Services and deliverables
Hostcari may provide managed hosting, website setup, website development, website care, file access, email tools, domain/DNS assistance, client portal features, and related support. Deliverables, timelines, plan limits, mailbox counts, website counts, storage, features, and support levels depend on the selected plan or written agreement.
4. Client responsibilities
Clients are responsible for providing accurate instructions, approvals, content, credentials, domain access, brand assets, legal permissions, and timely feedback. Delays in approvals, third-party access, content delivery, payment, or client decisions may affect timelines and launch dates.
5. Payments, pricing, and taxes
Prices, billing intervals, deposits, setup fees, renewals, and included services are shown at checkout, in the portal, on an invoice, or in a written agreement. Fees are due when stated. Client is responsible for applicable taxes, bank fees, currency conversion fees, chargeback fees, and third-party provider charges unless otherwise stated in writing.
6. Subscriptions, renewals, and cancellation
Recurring services renew until cancelled according to the plan, invoice, or agreement. Cancellation stops future service renewal but does not automatically refund fees already earned or paid unless required by law or expressly stated in writing. Hostcari may suspend or restrict services for unpaid invoices, abuse, security risk, or violation of these terms after reasonable notice where practical.
7. Refunds and consumer rights
Refund eligibility depends on the service purchased, work already performed, third-party costs, and applicable law. Custom work, setup work, domain/DNS work, hosting already provided, and third-party costs may be non-refundable once started or delivered. Where mandatory consumer protection laws provide cancellation, withdrawal, or refund rights, those legal rights will apply and these terms will not limit them.
8. Domains and third-party services
Hostcari does not act as a domain registrar unless expressly stated in writing. Clients are responsible for purchasing, renewing, and maintaining domain registrations and third-party accounts. Hostcari may assist with configuration, DNS, email, hosting, or integrations, but third-party services remain subject to their own terms, pricing, uptime, security, and availability.
9. Hosting and availability
Hostcari aims to provide reliable managed hosting, SSL visibility, backups, monitoring, and account tools according to the selected plan. No hosting, backup, security, email, DNS, or internet service can be guaranteed uninterrupted, error-free, or immune from all failures. Maintenance, provider outages, attacks, misconfiguration, third-party issues, and force majeure events may affect service.
10. Acceptable use
Clients must not use Hostcari services for unlawful, harmful, infringing, abusive, deceptive, spam, malware, phishing, harassment, hate, adult exploitative, or security-compromising activity. Hostcari may investigate, restrict, suspend, remove content, or terminate access where necessary to protect the platform, providers, clients, or the public.
11. Content, licenses, and permissions
Clients represent that they have the rights and permissions needed for content, images, logos, data, files, domains, software, plugins, and materials they provide. Clients grant Hostcari the limited permission needed to host, copy, modify, display, transmit, troubleshoot, and process those materials to provide the services.
12. Ownership and intellectual property
After final payment, the client owns the final custom website content and approved custom design deliverables created specifically for that client, unless a written agreement says otherwise. Hostcari, third-party software, frameworks, templates, stock assets, plugins, infrastructure, know-how, admin tools, reusable components, and underlying systems remain subject to their original ownership and license terms.
13. Portal access and security
Clients must protect portal access, authorized users, email accounts, API keys, credentials, and devices. Clients should notify Hostcari promptly about suspected unauthorized access or security incidents. Hostcari may require security steps, rotate access, restrict features, or pause service actions when needed to protect accounts.
14. Support and service requests
Support is provided according to the selected plan or written agreement. Response targets are not guaranteed resolution times unless expressly stated in writing. Requests outside the included plan, custom development, emergency work, content rewrites, complex repairs, migrations, or third-party troubleshooting may require a separate quote.
15. Disclaimers
Services are provided on a reasonable commercial efforts basis unless a written agreement states otherwise. Hostcari does not guarantee specific sales, search rankings, traffic, revenue, deliverability, uninterrupted uptime, or error-free operation. Client is responsible for reviewing deliverables, complying with laws applicable to its own business, and obtaining legal, tax, privacy, accessibility, or regulatory advice where needed.
16. Limitation of liability
To the maximum extent permitted by law, Hostcari will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, reputational harm, third-party failures, or downtime. Hostcari's aggregate liability for a claim will not exceed the amounts paid by the client to Hostcari for the affected service during the three months before the event giving rise to the claim, unless applicable law requires otherwise.
17. Indemnity
The client agrees to defend, indemnify, and hold Hostcari harmless from claims, losses, liabilities, damages, costs, and expenses arising from client content, client instructions, misuse of services, violation of law, infringement claims, unauthorized use of third-party materials, or breach of these terms.
18. Changes to services or terms
Hostcari may update services, plans, features, providers, pricing, and these Terms of Service from time to time. Material changes will be posted or communicated where appropriate. Continued use of the website, portal, or services after changes take effect means the client accepts the updated terms, except where a separate written agreement controls.
19. Governing rules and mandatory protections
These terms are intended to apply broadly while respecting mandatory rights that cannot legally be waived. If a provision is unenforceable in a jurisdiction, the remaining provisions continue to apply. Any jurisdiction-specific consumer, privacy, payment, or electronic commerce rights that apply by law will control where they conflict with these terms.
